Datonics clients are businesses, not individual consumers. As a result, this website is designed to provide information to, and in some instances, collect contact information from our existing and prospective clients who request information or services from us.  This information is only collected through direct correspondence with Datonics.

Datonics collects contact information on this website when visitors voluntarily provide such information to us. It is not necessary to provide any personal information in order to simply browse our website. Datonics may also automatically gather online identifiers such as IP addresses and information about user internet activity, such browsing history and browser type, and by using technologies such as cookies and other tracking technologies described below.

In addition to using your personal information ourselves for the reasons stated above (and as otherwise mentioned in this privacy policy), we may disclose your personal information to other affiliates and entities in the following instances:

  • Non-Personal Information: We may share non-personal information with unaffiliated third parties, such as business and advertising partners, manufacturers, distributors, and retailers, to improve and enhance your experience using the website, and for our own market research activities. WHAT TYPES OF SECURITY PROCEDURES ARE IN PLACE?

The security of your information is very important to us. Datonics follows generally accepted industry standards to protect your information. All information collected by the Datonics system is stored in databases that are stored in a secure data center located in the United States.  Both physical and Internet access is strictly protected and limited.  Access is granted only to those with authorization. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your information, we cannot guarantee its absolute security.

HOW DOES DATONICS RETAIN PERSONAL INFORMATION?

We will retain your personal information for as long as your inquiry is active or as needed with respect to the website, and for a reasonable time thereafter in accordance with our standard procedures or as necessary to comply with our legal obligations, to resolve disputes, and to enforce our agreements. Even if we delete some or all of your information, we may continue to retain and use anonymous or aggregate data, or any other data that constitutes non-personal information. Please note that we will not be liable for disclosures of your data due to errors or unauthorized acts of third parties.

HOW DO I OPT-OUT FROM RECEIVING PROMOTIONAL MESSAGES FROM DATONICS?

If you receive an unwanted email or other message from us, you can simply unsubscribe from future messages in accordance with our standard unsubscribe process (such as by using the unsubscribe link included in an email), reply and ask not to receive future emails, or send an email to privacy@datonics.com and request that your email address not be retained.

Consumer privacy rights 

If you are a resident of California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, New Hampshire, Delaware, Iowa, Nebraska, New Jersey, Tennessee, Minnesota, Maryland, or another U.S. state that has similar privacy legislation (collectively, “Covered States”), you may have specific rights regarding your personal information under: the California Consumer Privacy Act (“CCPA”), Virginia Consumer Data Protection Act, Colorado Privacy Act, Connecticut Data Privacy Act, Utah Consumer Privacy Act, Texas Data Privacy and Security Act, Oregon Consumer Privacy Act, Montana Consumer Data Privacy Act, New Hampshire Data Privacy Act, Delaware Personal Data Privacy Act, Iowa Consumer Data Protection Act, Nebraska Data Privacy Act, New Jersey Data Protection Act, Tennessee Information Protection Act, Minnesota Consumer Data Privacy Act, Maryland Online Data Privacy Act, or similar laws in other U.S. states (collectively, "State Privacy Laws").   • Right to know. You may have the right to know whether we process your personal information and to access such personal information. You may also have the right to request that we disclose certain information to you about our collection, use, or disclosure of your personal information. You may also have the right to obtain a list of the categories of third parties to which we have disclosed personal information.

  • Right to data portability. You may have the right to obtain a copy of your personal information that you previously provided to us in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another business without hindrance, where the processing is carried out by automated means.

  • Right to delete. You may have the right to delete personal information that you have provided by or that we have obtained about you. Please note that we may deny such request if the requested deletion falls under an exception as set forth in the State Privacy Laws. Additionally, for residents of Colorado, Connecticut, and Texas, if you request deletion of your personal information and we have obtained such information from a third-party source, we may retain such data by keeping a record of the deletion request and the minimum data necessary to ensure that your personal information remains deleted from our records and that such retained data is not used for any other purpose, or we may opt you out of the processing of such personal information for any purpose except for those allowed under State Privacy Laws. Some State Privacy Laws, like those of Iowa and Utah, limit this right to only the data you have provided us.

  • Right to correct. Unless you reside in Iowa or Utah, you have the right to correct inaccuracies in your personal information, taking into account the nature of the personal information and the purposes for which we process it.

  • Right to opt out. You have the right to opt out of the processing of your personal information for purposes of: (i) targeted advertising; (ii) the sale of personal information; or (iii) profiling in furtherance of decisions that produce legal or similarly significant effects concerning you, unless you reside in Iowa or Utah. As of the latest date of the Privacy Policy, we do not use personal information collected on this website for targeted advertising, profiling in furtherance of decisions that produce legal or similarly significant effects concerning you or for “sales” or “shares” (as defined under State Privacy Laws).

  • Right to nondiscrimination. You have the right not to receive discriminatory treatment by us for the exercise of your privacy rights. Unless permitted by the State Privacy Laws, we will not:

    • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;

    • Provide you a different level or quality of goods or services; or

    • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

 

Exercising Your Privacy Choices.

Only you, or a proper agent authorized to act on your behalf (an “authorized agent”), may make the requests set forth above. We will require the authorized agent to provide a signed writing from you designating them as your authorized agent and we will need to verify both the identity of the authorized agent and your identity. You may also make a request on behalf of your minor child. 

Requests should include your contact information and describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. In order to protect the security of your personal information, we will not honor a request if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. The method used to verify your identity will vary depending on the nature of the request. Generally speaking, verification will be performed by matching the identifying information provided by you to the personal information that we already have. 

We will respond to consumer requests within 45 days from when you contacted us. If you have a complex request, applicable law may allow us up to 90 days to respond. If we require extra time to respond, we will still contact you within 45 days from when you contacted us and inform you of the reason and extension period in writing.  If we decline to take action on a request that you have submitted, we will inform you of our reasons for doing so, and provide instructions for how to appeal the decision. Depending on your state of residence you may have the right to appeal within a reasonable period of time after you have received our decision. If you have this appeal right, within 60 days (45 days for residents of Colorado) of our receipt of your appeal, we will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If we deny your appeal, we will provide you with a method for contacting your state attorney general’s office to submit a complaint.

We are not obligated to provide the information set forth above under “Right to Know About Personal Information Collected, Disclosed or Sold” more than twice in a 12-month period. 

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

This website is intended for users ages 18 and over, and we do not knowingly collect personal information from children under the age of 18. When we become aware that personal information (or other information that is protected under applicable law) from a child under 18 has been collected, we will use all reasonable efforts to delete such information from our databases. If you submit personal information to us, that information may be processed in a jurisdiction where privacy laws may be less stringent than those in your country of residence. The Datonics website is maintained in the United States of America. By using this website, you authorize the export of any personal information you submit to us, as well as the non-personal information collected by this website, to the USA, and its storage and use as specified in this policy. Please note that personal information transferred to the United States is subject to access by law enforcement.

If you have submitted personal information to Datonics via email and would like that information to be removed from our database, please send an email to privacy@datonics.com and request that your information be removed.

CHANGES TO THIS POLICY

If we decide to change our privacy policy, we will post those changes to this privacy statement and other places we deem appropriate so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it.  We reserve the right to modify this privacy statement at any time, so please review it frequently.  If we make material changes to this policy, we will notify you here. Any updated version of this privacy policy will be effective immediately upon posting unless otherwise specified. Your continued use of this website after the effective date of the revised privacy policy will constitute your consent to those changes. However, we will not, without your consent, use your personal information in a manner materially different from what was stated at the time your personal information was collected.
